Legal and Privacy
Our website terms, privacy practices, cookies, and email consent in one place.
This page sets out the policies that apply when you visit Aspire Canada Tours’ website, subscribe to our emails, or interact with our content. The sections below explain acceptable use of the site, how we use cookies and tracking tools, how marketing consent works under CASL, and how we collect, use, and disclose personal information. Booking Terms and Conditions apply to purchases made through our Adventure Engine checkout and are provided during booking.
Website Terms of Use
Last updated: February 21, 2026
These Website Terms of Use (the “Terms”) govern your access to and use of the Aspire Canada Tours Inc. website and any related pages, forms, and content (collectively, the “Site”).
The Site is operated by Aspire Canada Tours Inc. (“ACT”, “we”, “us”, “our”), a British Columbia company.
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1) Booking terms are separate
If you make a booking, request a quote, or purchase travel services, your transaction is governed by our Booking Terms and Conditions and any booking-specific policies presented during checkout or in your confirmation materials. These Terms apply only to Site use, not to the purchase of travel services.
2) Changes to these Terms
We may update these Terms from time to time. The “Last updated” date shows when changes take effect. Your continued use of the Site after changes means you accept the updated Terms.
3) Eligibility
You must be able to form a legally binding contract in your jurisdiction to use the Site. If you are using the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
4) Acceptable use
You agree not to, and not to attempt to:
- use the Site in any way that violates applicable law;
- interfere with the security or operation of the Site, including introducing malware, probing, scanning, or testing vulnerabilities;
- access or use the Site using automated means (including bots, scrapers, or spiders) except where permitted by law and consistent with reasonable, non-disruptive use;
- attempt to gain unauthorised access to any accounts, systems, or data;
- impersonate any person or misrepresent your affiliation with any person or entity;
- use the Site to send unsolicited or unlawful communications.
We may suspend or restrict access to the Site if we reasonably believe these Terms have been violated.
5) Intellectual property and trademarks
Unless otherwise noted, the Site and all content on it, including text, images, photographs, videos, design elements, graphics, logos, and compilations (the “Content”), are owned by ACT or used under licence, and are protected by copyright, trademark, and other laws.
Limited permission: We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site and Content for your personal, non-commercial use and for legitimate business evaluation of our services. No other rights are granted.
You may not copy, reproduce, republish, distribute, publicly display, modify, create derivative works from, or exploit any Content without our prior written permission, except as permitted by law.
Trademarks: “Aspire Canada Tours” and related marks, logos, and branding are trademarks or trade dress of ACT. Third-party trademarks (including partner and platform names) are the property of their respective owners.
6) User submissions
If you submit information through the Site (for example, contact forms, newsletter signups, quote requests, feedback, or inquiries), you agree that:
- the information you provide is accurate to the best of your knowledge;
- you will not submit unlawful, defamatory, or infringing content;
- you will not submit confidential or proprietary information you do not have the right to share.
To the extent you submit feedback or suggestions, you grant ACT a perpetual, worldwide, royalty-free licence to use, reproduce, modify, and incorporate that feedback into our operations and services, without compensation to you.
7) Third-party sites and services (including booking platforms)
The Site may link to, embed, or integrate third-party websites or services, including booking and payment platforms (for example, Adventure Engine) and partner or supplier sites (“Third-Party Services”).
Third-Party Services are provided by third parties, not by ACT. We do not control them and do not guarantee their availability, accuracy, security, or performance. Your use of Third-Party Services is governed by the third party’s terms and policies. Links are provided for convenience and do not imply endorsement unless we expressly state otherwise.
8) No warranties, “as-is” website disclaimer
The Site and Content are provided “as is” and “as available”. To the fullest extent permitted by law, ACT disclaims all warranties and conditions, whether express, implied, or statutory, including implied warranties or conditions of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the above, we do not warrant that:
- the Site will be uninterrupted, error-free, or secure;
- Content will be accurate, complete, current, or suitable for your purposes;
- defects will be corrected.
Content on the Site may include general travel information. It is not legal, medical, tax, or other professional advice. For official travel requirements or advisories, consult relevant government sources.
9) Limitation of liability
To the fullest extent permitted by law, ACT and its directors, officers, employees, contractors, and agents will not be liable for any loss or damages arising out of or relating to your use of, or inability to use, the Site, including any indirect, incidental, special, consequential, or punitive damages, loss of profits, loss of data, business interruption, or reputational harm, even if we were advised of the possibility.
To the fullest extent permitted by law, ACT’s total liability for any claim arising out of or relating to the Site or these Terms will not exceed CAD $100.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. In such cases, liability will be limited to the maximum extent permitted by applicable law.
10) Indemnity
You agree to indemnify and hold harmless ACT and its directors, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your misuse of the Site, your violation of these Terms, or your infringement of any rights of any third party.
11) Privacy
Our collection, use, and disclosure of personal information is described in our Privacy Policy, which forms part of your agreement with us when you use the Site.
12) Governing law and venue
These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict of laws principles.
You agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the courts of British Columbia, and you submit to the personal jurisdiction of those courts.
13) General
- Severability: If any provision is found unlawful or unenforceable, the remaining provisions remain in effect.
- No waiver: Our failure to enforce any provision is not a waiver of that provision.
- Entire agreement: These Terms (together with any documents they expressly incorporate by reference, such as the Privacy Policy) constitute the entire agreement regarding Site use.

Some parts of your interaction with ACT involve third-party services that have their own cookies and privacy practices.

Last updated: February21, 2026
This page explains how Aspire Canada Tours Inc. (“ACT”, “we”, “us”, “our”) sends email communications, including marketing emails and service-related messages.
1) What subscribers will receive
If you subscribe to the Aspire Canada Tours newsletter or otherwise opt in to marketing communications, you can expect to receive emails such as:

2) Consent to receive marketing emails
When you subscribe through our Site (for example, by entering your email and selecting “Subscribe”, or by checking a marketing opt-in box), you are providing express consent to receive commercial electronic messages from ACT.
Our requests for consent include our identification and contact information and a statement that you can withdraw consent.
In some situations, CASL also allows marketing emails based on implied consent (for example, certain existing business relationships). If we email you under implied consent, you can still unsubscribe at any time.
3) Unsubscribing and managing preferences
Unsubscribe link: Every ACT marketing email includes an unsubscribe link or instructions that allow you to unsubscribe at no cost.
Other unsubscribe options: You can also request to unsubscribe by contacting us using the details in the “Contact” section below.
Timing: We action unsubscribe requests without delay, and in any event no later than 10 business days after the request is sent.
Keeping your opt-out in place: After you unsubscribe, we may keep a minimal record of your request (for example, your email address on a suppression list) so we can respect your preference.
4) Operational emails still required to deliver services
You can unsubscribe from ACT marketing emails at any time. Operational emails related to bookings, payments, or flight operations may still be sent as required to deliver services.
Examples include:

- flight-related communications when air is included (including itineraries, check-in invitations, boarding information, schedule changes, and disruption notices from Air North, Yukon’s Airline)
5) Identification information in our emails
CASL requires that commercial electronic messages include identification and contact information for the sender (and, if applicable, the person on whose behalf the message is sent).
ACT marketing emails include:
- our business name
- our mailing address
- at least one additional contact method (phone, email, or web address)
- a working unsubscribe mechanism
6) Email service provider and tracking
We use HubSpot to manage subscriber lists and send marketing emails. HubSpot and similar email systems typically use standard technologies (such as pixels and link tracking) to measure email performance (for example, opens and clicks). You can reduce this type of tracking by adjusting your email client settings (for example, blocking images or disabling automatic image loading). Our Cookie and Tracking Notice explains our website tracking in more detail.
